are entirely responsible for maintaining the confidentiality of your username(s), password(s), and your account(s), as well as all activities that occur under your account(s). You hereby agree to indemnify, defend, and hold us, our licensors, licensees, distributors, agents, representatives and other authorized users, and each of the foregoing entities' respective resellers, distributors, service providers and suppliers, and all of the foregoing entities' respective officers, directors, owners, employees, agents, representatives and assigns (collectively, the “Indemnified Parties”) harmless from and against any and all losses, damages, liabilities and costs (including, without limitation, settlement costs and any legal or other fees and expenses for investigating or defending any actions or threatened actions) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these terms of use or claims arising from your account(s). You shall use your best efforts to cooperate with us in the defense of any claim. We reserve the right, at our own expense, to employ separate counsel and assume the exclusive defense and control of any matter otherwise subject to indemnification by you.

Compliance with the law

We reserve the right to comply with any subpoena, order or otherwise cooperate with law enforcement officials regarding the identification of any user alleged to be using nationalinterest.org in violation of the law. If we deem appropriate in our sole discretion, we reserve the right to preserve a record of any such information/data and turn all or a portion thereof over to law enforcement officials.

Special Agreement on Fee-Shifting and Choice of Law

If you attempt to bring any legal action against The National Interest based in any way on its products or services, including the site, you agree that, in the event you do not prevail or The National Interest does prevail, you will reimburse The National Interest for any costs and attorneys fees associated with their defense of the action.

The use of the site and any claim or dispute relating to the site shall be governed by the laws of the District of Columbia, without regard to its conflicts of law principles. Exclusive venue for any claim shall be in the state and federal courts located in the District of Columbia. Use of the site is unauthorized in any jurisdiction that does not affect all provisions of these terms and conditions, including without limitation this paragraph.

Severability

If any provision or portion of these terms and conditions is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire agreement will be severable and will remain in effect, to the fullest degree consistent with the intent of this document.
